19720817 Duke University NCAA Violations
Dike University, Durham, North Carolina
WHEREAS, the NCAA Committee on Infractions has investigated alleged violations of the
Association's legislation on the part of Duke University and has reported its findings to the
NCAA Council;
WHEREAS, the Council has found Duke University to have violated the provisions governing
recruiting [NCAA Bylaws 6-1 and 6-5-(e), 1970-71 NCAA MANUAL], in
1. A representative of the University's athletic interests excessively
entertained a then prospective student-athlete at the 1971 Atlantic Coast
Conference Basketball Tournament, Greensboro, North Carolina. Specifically, the
representative paid for the prospect's tickets to the Tournament as well as for
room, board and other incidental expenses incurred by the young man during this
period, March 4-6, 1971.
2. On April 12, 1971, a representative of the university's athletic interests
transported two then prospective student-athletes from their hometown, Boiling
Springs, North Carolina, to Charlotte, North Carolina, where the representative
purchased a sport coat, pair of slacks, a shirt and tie for one of the young men.
WHEREAS, the Council has found Duke University to have vio1ated the provisions governing
recruiting [NCAA Bylaw 6-5-(d), 1970-71 NCAA MANUAL], in that:
1. A representative of the university's athletic interests arranged
transportation for a then prospective student-athlete from the prospects home to
Greensboro, North Carolina, and provided return transportation in order that the
young man could be entertained at the 1971 Atlantic Coast Conference Basketball
Tournament.
WHEREAS, the Council believes that the violations set forth herein were a result of efforts by a
representative of the Duke University's athletic interests to encourage the prospective studentathlete
to enroll at the University;
WHEREAS, the Council has concluded that Duke University's head basketball coach and an
assistant basketball coach were in a position to know and should have known that the individual
entertaining the prospective student-athlete at the 1971 Atlantic Coast Conference. Basketball
Tournament was a representative of the University's athletic interests, and therefore should not
have entertained the prospect in this manner;
WHEREAS, the Council has noted that although no member of the Duke University's athletic
department was aware that the representative of its athletic interests was going to purchase
clothing for the prospective student-athlete, an NCAA member institution is responsible for any
actions of its athletic representatives in the recruitment of prospective student-athletes;
NOW THEREFORE, BE IT RESOLVED, that the Council reprimand and censure Duke
University;
BE IT FURTHER RESOLVED, that. Duke University be placed on probation for a period of one
year from this date (August 17, 1972), it being understood that prior to the expiration of this
probationary period the NCAA Committee on Infractions shall review the athletic policies and.
practices of the institution;
BE IT FURTHER RESOLVED, that during the period of this probation, the basketball team of
the University shall end its season with the playing of the last, regularly scheduled, inseason
game and it shall not be eligible to participate in any postseason basketball competition;
BE IT FINALLY RESOLVED, that record be made of the excellent assistance and cooperation
extended to the NCAA and its Committee on Infractions by Duke University and the
commissioner of the Atlantic Coast Conference.
